(AP) ? The Senate Foreign Relations Committee is scheduled to vote Tuesday on President Barack Obama's nomination of Sen. John Kerry to be the next secretary of state.

If approved, the nomination would move to the full Senate, which is expected to act swiftly on the choice.

Obama chose the five-term Massachusetts senator and 2004 Democratic presidential candidate to succeed Secretary of State Hillary Rodham Clinton, who is stepping down after four years.

Kerry has served on the Foreign Relations panel for 28 years and led the committee for the last four. He is the son of a diplomat and a decorated Vietnam veteran.

Obama is overhauling his national security team. The president has nominated Chuck Hagel for defense secretary and John Brennan to serve as CIA director.

Casey Anthony files for bankruptcy protection

After a court acquitted her of murder charges, Casey Anthony is filing for bankruptcy, saying she's only worth $1,100 and still owes close to $800,000 to her lawyers and law enforcement officials.

Anthony owes about $792,000 -- most of it to her defense attorney, according to a Chapter 7 petition filed Friday in U.S. Bankruptcy Court, The Associated Press reported.

She also faces three civil lawsuits stemming from the disappearance of her daughter, Caylee Marie, ?the Orlando Sentinel reported.?The 2-year-old girl was reported missing in July 2008 and her body was found that December near the home of Casey Anthony's parents in the Orlando area.


Anthony was found not guilty of murder in July 2011 but was convicted of lying about the child's disappearance. She was sentenced to time served, and on Friday an appeals court struck down two of the lying convictions.

Anthony claimed that a babysitter had kidnapped Caylee, and a woman with the same name is suing for defamation, as is the former meter reader who found the body -- he says Anthony's attorneys damaged him by painting him as a possible killer.

The third suit is by Texas EquuSearch, a search and rescue organization, which says it spent more than $100,000 searching for Caylee.

Anthony's bankruptcy filing said she had only $1,084; here are her main debts, according to the Sentinel report:

Senators reach agreement on immigration reform

WASHINGTON (AP) ? A bipartisan group of leading senators has reached agreement on the principles of sweeping legislation to rewrite the nation's immigration laws.

The deal, which was to be announced at a news conference Monday afternoon, covers border security, guest workers and employer verification, as well as a path to citizenship for the 11 million illegal immigrants already in this country.

Although thorny details remain to be negotiated and success is far from certain, the development heralds the start of what could be the most significant effort in years toward overhauling the nation's inefficient patchwork of immigration laws.

President Barack Obama also is committed to enacting comprehensive immigration legislation and will travel to Nevada on Tuesday to lay out his vision, which is expected to overlap in important ways with the Senate effort.

The eight senators expected to endorse the new principles Monday are Democrats Charles Schumer of New York, Dick Durbin of Illinois, Robert Menendez of New Jersey and Michael Bennet of Colorado; and Republicans John McCain of Arizona, Lindsey Graham of South Carolina, Marco Rubio of Florida and Jeff Flake of Arizona.

Several of these lawmakers have worked for years on the issue. McCain collaborated with the late Democratic Sen. Edward M. Kennedy on comprehensive immigration legislation pushed by then-President George W. Bush in 2007, only to see it collapse in the Senate when it couldn't get enough GOP support.

Now, with some Republicans chastened by the November elections which demonstrated the importance of Latino voters and their increasing commitment to Democrats, some in the GOP say this time will be different.

"What's changed, honestly, is that there is a new, I think, appreciation on both sides of the aisle ? including maybe more importantly on the Republican side of the aisle ? that we have to enact a comprehensive immigration reform bill," McCain said Sunday on ABC's "This Week."

"I think the time is right," McCain said.

The group claims a notable newcomer in Rubio, a potential 2016 presidential candidate whose conservative bona fides may help smooth the way for support among conservatives wary of anything that smacks of amnesty. In an opinion piece published Sunday in the Las Vegas Review-Journal, Rubio wrote that the existing system amounts to "de facto amnesty," and he called for "commonsense reform."

According to documents obtained by The Associated Press, the senators will call for accomplishing four goals:

?Creating a path to citizenship for illegal immigrants already here, contingent upon securing the border and better tracking of people here on visas.

?Reforming the legal immigration system, including awarding green cards to immigrants who obtain advanced degrees in science, math, technology or engineering from an American university.

?Creating an effective employment verification system to ensure that employers do not hire illegal immigrants.

?Allowing more low-skill workers into the country and allowing employers to hire immigrants if they can demonstrate they couldn't recruit a U.S. citizen; and establishing an agricultural worker program.

The principles being released Monday are outlined on just over four pages, leaving plenty of details left to fill in. What the senators do call for is similar to Obama's goals and some past efforts by Democrats and Republicans, since there's wide agreement in identifying problems with the current immigration system. The most difficult disagreement is likely to arise over how to accomplish the path to citizenship.

In order to satisfy the concerns of Rubio and other Republicans, the senators are calling for the completion of steps on border security and oversight of those here on visas before taking major steps forward on the path to citizenship.

Even then, those here illegally would have to qualify for a "probationary legal status" that would allow them to live and work here ? but not qualify for federal benefits ? before being able to apply for permanent residency. Once they are allowed to apply they would do so behind everyone else already in line for a green card within the current immigration system.

That could be a highly cumbersome process, but how to make it more workable is being left to future negotiations. The senators envision a more streamlined process toward citizenship for immigrants brought here as children by their parents, and for agricultural workers.

The debate will play out at the start of Obama's second term, as he aims to spend the political capital afforded him by his re-election victory on an issue that has eluded past presidents and stymied him during his first term despite his promises to the Latino community to act.

"As the president has made clear for some time, immigration reform is an important priority and he is pleased that progress is being made with bipartisan support," a White House spokesman, Clark Stevens, said in a statement. "At the same time, he will not be satisfied until there is meaningful reform and he will continue to urge Congress to act until that is achieved."

For Republicans, the November elections were a stark schooling on the importance of Latino voters, who voted for Obama over Republican Mitt Romney 71 percent to 27 percent, helping ensure Obama's victory. That led some Republican leaders to conclude that supporting immigration reform with a path to citizenship has become a political imperative.

SPICY IP: Part I: Is decompilation of software legal under the Indian ...

In discussions with a few of my colleagues in software development related to mobile applications for Android, Windows, and iOS platforms, a question arose whether studying an existing application (already developed and available for a device) and using the existing application as a study tool is legal under the Indian Copyright Act? ?At first glance the relevant provision (Section 52) under the Indian Copyright Act prescribes that studying software is legal. ? ?
However, there are many practical issues that come up while analyzing the statute: As developers know, one cannot study software without first decompiling it.? Decompilation, ?inter-operability?, are words that are not defined in the Act.? Decompilation may be equated to reverse engineering of a product ? whether software or hardware. This post analyzes Section 52 of the statute and in particular sub-sections 52(ab) and (ac), and find whether reverse engineering / decompilation of software applications is legal. ?The answer to the question is not exactly clear ? For Indian, maybe it is ?- given ?the way in which other jurisdictions have applied the similar statutes.? This post is divided into two parts.? Part I deals with the background information as relates to the development of decompilation / reverse engineering laws in US and Europe. Part II deals with the application of these laws to the Indian context.? Long post follows. Because European law on copyright protection of computer programs is based on the counterpart American experience, American jurisprudence is discussed first. REVERSE ENGINEERING IN US: Under American law, until recently, there were no explicit provisions about decompilation or reverse engineering. The basic copyright law, that has been amended from time-to-time just provides fair use exceptions and courts are left free to interpret fair use. In 2010, the Library of Congress with the US Register of Copyrights, provided six additional classes, that would not be considered infringement. See link.? Relevant to the issue of reverse engineering are the classes: ?..(2) Computer programs that enable wireless telephone handsets to execute software applications, where circumvention is accomplished for the sole purpose of enabling interoperability of such applications, when they have been lawfully obtained, with computer programs on the telephone handset.

Case law sets out guidelines about reverse engineering.? And it was under the provisions of section 107 (fair use) that reverse engineering was addressed.?

The first case to be taken up by US Courts on the issue of reverse engineering was: Sega Enterprises Ltd. v. Accolade, Inc.:?In Sega, Sega manufactured a video game console under a brand name Genesis. ?The console contained a lock-out device (microchip) which looked for a particular code sequence in a game cartridge. This code sequence was provided only on Sega manufactured cartridges and no other.? Cartridges manufactured by other manufacturer did not have this code sequence, and could not function with the Sega console.?

Accolado, a game maker, also provided games on cartridges.? To be able to use a game cartridge from Accolado with the Genesis console, Accolade disassembled the Genesis console and found the chip containing the code reader, and found out the specific code sequence which Sega put in their cartridges.? This made it possible for Accolade to manufacture cartridges compatible with the Genesis console. ?During the process of reverse engineering Accolado made several copies of Sega?s micro code and thereby infringing Sega?s copyright. Sega suited for this infringement of their copyright to the specific microcode system and Accolado claimed fair use. ?The District court in the Northern District of California found for Sega, that an infringement had taken place and it ?could not be seen as a fair use because of the commercial nature of the reverse engineering.? ?The Court of Appeal found otherwise and reversed the district court. ?Decompilation was an infringement of Sega?s copyright but was found to be fair use. The court stated that if "disassembly provides the only means of access to those elements of the code not protected by copyright and the copier has a legitimate reason for seeking such access" is a fair use of the copyrighted work. The court stated that reverse engineering is a fair use if the purpose is to achieve compatibility between an original (i.e. not copied from another) computer program, and a device for using this program. The second case taken up by US Courts about reverse engineering also involved video game consoles, and was Atari Games corp. v. Nintendo of America, Inc.? In Atari, the consoles were manufactured by Nintendo.? However, Nintendo also had a patent on the security lock-out device.? Atari had tried to reverse engineer the microchip but failed.? However, Atari obtained the information related to the microchip from the US Copyright Office (Library of Congress), claiming they needed this information in a litigation with Nintendo. Atari thereafter created a program that emulated the Nintendo lock-out microchip, and this made it possible for Atari?s game cartridges to be used on Nintendo consoles.? The district court specifically ruled that Atari had, when creating the compatible program used more than necessary to get compatibility.

Nintendo filed for copyright and patent infringement and was successful at the district court ? Atari?s claim for fair use was not accepted.? The Court of Appeal for the Federal Circuit (CAFC) came to the same conclusion and ruled, ?reverse engineering was fair use only when the original product had been purchased legally.?? Getting the information from the US Copyright Office on false grounds destroyed any possibility for Atari to successfully claim fair use. ?However, before these questions were tested the case was settled.

This case showed that copying a program to understand and copy unprotected underlying ideas would have been probably been alright if Atari had achieved information legally.? In a third case, in Vault Corp. v. Quaid Software Ltd., the court decided that a Louisiana Software License Enforcement Act clause permitting a copyright holder to prohibit software decompilation or disassembly was preempted by the Copyright Act, and was therefore unenforceable. REVERSE ENGINEERING IN Europe: In EU copyright protection of computer programs is an outcome of computer program Directive. ?See link. The concept of reverse engineering was not unique to EU law. Before it, Art. 15 of the EC semiconductor chip protection Directive permitted reverse engineering of the layout of a semiconductor microchip. ?This semiconductor related directive was similar to that of the US Semiconductor Chip Act of 1980 where provisions relating to decompilation were explicitly provided. The computer programs Directive (hereafter Directive) contains two different provisions relating access to interface information. Article 5(3) deals with reverse analysis techniques other than decompilation, (also known as black box method). ?Article 6 deals with decompilation methods themselves. ? Black Box Method (or passive monitoring method):

An engineer starting to develop a product with a particular standard may start work from published documentation about the interface information with that standard. ?Usually because source code is not published, and available documentation is often incomplete or out dated, it is necessary to conduct reverse analysis to ascertain the interface information required to provide an interoperable product.

Generally, this information may be learned from "black box" reverse engineering ?techniques. These techniques merely involve monitoring the activity of an existing product and are passive in nature ? i.e. there is no active monitoring of do not involve translation of the analyzed program?s object code into the original source code. ?Examples of information that may be obtained through black box techniques are test runs, line traces, storage data dumps and screen rendering. Article 5(3) of the Directive provides 3. The person having a right to use a copy of a computer program shall be entitled, without the authorisation of the right?holder, to observe, study or test the functioning of the program in order to determine the ideas and principles which underlie any element of the program if he does so while performing any of the acts of loading, displaying, running, transmitting or storing the program which he is entitled to do.? Emphasis added. There are multiple aspects to this article in the Directive: First the person invoking the Article must have a right to use a copy of a computer program.? Hence this is the first hurdle that is passed by legitimate software licensees or owners (no pirates please). Most developers who intend to develop interoperable products would be licensed users of the original product for which the new product is being developed.? As an example, consider various tools created by different third party developers for Adobe? Photoshop? software.?? All such developers are usually licensed users for the Photoshop? software.? Hence it is permissible for them to analyze a copy legitimately. Second, Article 5(3) permits a developer to observe study or test the functioning of the program. ?This is what a developer does when conducting black box analysis. Third and most importantly, Article 5(3) permits the developer to determine the "ideas and principles" underlying any element of the computer program. This includes determining interface specifications which being the rules and methods by which a program interacts with other products, constitutes "ideas and principles". Fourth, Article 5(3) permits the developer to observe, study and test the functioning of the program while "loading, displaying, running, transmitting or storing" the program. Finally, Article 5(3) provides that for the analysis to be allowed, one must be "entitled to do" the underlying operation involved. ?Accordingly, this is tied to the first part in the article, and is a second tier protection against use of this article illegitimately to expand permitted use of a program. In some cases techniques permitted by Article 5(3) do not yield enough interface information required. It then becomes necessary to decompile a program ?i.e. active monitoring is required. ?Article 6 of computer program Directive provides the required freedom for decompilation. Article 6 of the Directive: 1. The authorisation of the rightholder shall not be required where reproduction of the code and translation of its form within the meaning of points (a) and (b) of Article 4(1) are indispensable to obtain the information necessary to achieve the interoperability of an independently created computer program with other programs, provided that the following conditions are met: (a) those acts are performed by the licensee or by another person having a right to use a copy of a program, or on their behalf by a person authorised to do so; (b) the information necessary to achieve interoperability has not previously been readily available to the persons referred to in point (a); and (c) those acts are confined to the parts of the original program which are necessary in order to achieve interoperability. 2. The provisions of paragraph 1 shall not permit the information obtained through its application: (a) to be used for goals other than to achieve the interoper?ability of the independently created computer program; (b) to be given to others, except when necessary for the inter?operability of the independently created computer program; or (c) to be used for the development, production or marketing of a computer program substantially similar in its expression, or for any other act which infringes copyright. From Article 6, it seems that decompilation of a program may not be done solely to research its underlying ideas unrelated to interoperability and then implement those ideas in a program that competes with the decompiled program. The word indispensable has been used in Article 6.? This word suggests that it is not a mere wish but rather is required (grammatical construct: Air is required for breathing).? In practice, because decompilation requires great sophistication, time and expense and will not be conducted lightly: accordingly if a developer decompiles software then the reasons for decompilation would play a great role, most probably in the developer?s favor.? This then becomes an economic standard for indispensability.? * Hence the usage of reports, and the initial pilot study to confirm data theft ? are economically justified and decompilation is indispensable. Under Article 6(a), the act of decompilation is done by a legitimate user.? Compare this provision to the Atari case discussed above ? where Atari lost on both grounds and fair use exception under US law was not available to it. Under Article 6(b), necessary interface information must not have been previously been readily available to the developer. ?This provision should be interpreted according to the the economic hardship theory ? i.e. economically justified and indispensable. Under Article 6(c), decompilation must be confined to the parts of a program that are necessary to ensure interoperability. ??This seems to be a grey area: it is not entirely clear how only a specific part of a program can be decompiled, leaving the rest untouched.? In software, either a program is decompiled or not ? there are no mid-level choices available. In addition, software code is not written as a text book that has a page number to start and end with.? Software is written in parts ? where one part may invoke another and vice-versa.? Article 6, paragraph 2 limits the scope of Article 6 ? and accordingly limits what may be done with the decompilation.? The limitation is with regard to interoperability : information gained through decompilation may be used only to achieve the interoperability of the independently created program. Article 5(3) therefore, is very different from Article 6, and has no such restriction.

Article 6, paragraph (2)(c) provides that information obtained through decompilation may not be used for the development production or marketing of a computer program substantially similar in its expression, or for any other act which infringes copyright. * Here it may be argued that an employee is restricted from decompiling a program created for his employer?s purpose, AND cannot use a decompiled program to create a competing program as that of his employer.

Artspace LondonARTSPACE London is one of London's lesser-known art venues for out-of-town visitors. It opened in May of 2012 and focuses on Modern and Contemporary Arab, Iranian and Turkish art. The original ARTSPACE is in Dubai, and the owners decided to open a London branch to expose these Eastern artists to a Western audience.

The latest London exhibition is of Iraqi photographer Halim Al Karim, opening this year to mark the tenth anniversary of the invasion that led to the downfall of Saddam Hussein's Baathist government.

Al Karim felt the oppression of that regime as much as any Iraqi. He was an opponent of the dictatorship and refused to serve his compulsory military service. To avoid being imprisoned and tortured by Saddam's goons, he hid out in the desert for three years, where he lived in a hole in the ground and was fed by local Bedouin.

How that experience morphed into the surreal yet delicate image shown here is for the viewer to resolve. His show, "Witness from Baghdad," displays a range of works from throughout his career. Many confront the issues of war and oppression head on, yet always in a creative and distinct way.

"Halim Al Karim: Witness from Baghdad 2013" runs until February 23. If you won't be in London in time to catch it, show up at ARTSPACE London anyway. It's fast becoming a landmark on the London art scene.

Muhammad H. Zaman: Talk Is Cheap: Solving Global Mental Health ...

Despite growing up in Pakistan, I knew who Marty McFly was. He was my nerdy hero in Back to the Future. For me, Michael J. Fox represented all that was cool and exciting about science and invention. Years later, when I discovered Michael's battles with Parkinson's, I was devastated. I did not know much about Parkinson's except that it had also affected the hero of my parents and my elder siblings, Muhammad Ali. As I read more I realized that it is something that we do not fully understand, something elusive, unclear and messy. I had always wished that someone would come up with a solution that is befitting of Marty's character, something cool, simple and brilliantly imaginative. Max Little's solution, as he discusses in the TEDTalk, will hopefully take us back to the future without the burden of Parkinson's.

Parkinson's disease just does not affect Michael, Muhammad Ali and our favorite celebrities and heroes. It affects people all around us, all over the world. Over 6.5 million men and women worldwide are affected in countries rich and poor. In poor countries, the burden of mental health diseases is particularly profound and painful. The problems of diagnosis and management are already much worse than the developed world, but fatalism, stigma and taboo around mental disorders make these diseases even more difficult for the patients, families and caregivers. There is a dire and an urgent need for simple, robust and easy to manage solutions to diagnose, manage and cure Parkinson's. We desperately need a solution that is cheap and uses the resource available to all, not just to those who are privileged and live in rich countries.

What Max is trying to accomplish for Parkinson's is exciting for me on so many levels. First, he is working on a problem that is truly global and not just a problem of a select few. Second, he is addressing a messy and complex problem, that comes with not only biological complexity but also social stigma and societal challenges for the patient and the caregivers. But for me, the best part is that he is using a solution that is simple, easily accessible and cheap. There is no question that mobile phones have transformed the way we live, but it is the ability to use the same phone call for the global good, that is the most inspirational part. Using a simple phone call to help not just yourself but others with similar difficulties in countries you have never heard of is not only a highly creative solution, it is also the right way to think about global mental health. It is a powerful reminder that we are all in it together. The approach is also inspirational for all those who see difficult health problems in their homes and villages, want to do something about them, but get discouraged by the lack of material resources. For me, Max provides them an inspiration to think big, to combine the most common of tools with the most precious of resources, creativity and imagination. I hope that this mobile phone based approach will not only aid in the discovery of Parkinson's biomarkers but some day, a Max Little in Boston or a nurse in Bhutan, an engineer in Bolivia or an ordinary citizen in Botswana will use ingenuity, creativity and imagination to come up with a comprehensive cure of this and many other diseases.

Ideas are not set in stone. When exposed to thoughtful people, they morph and adapt into their most potent form. Assange: WikiLeaks film script leaked to WikiLeaks

(AP) ? If you're making a movie about WikiLeaks, this is the kind of thing you probably see coming.

Julian Assange says he has obtained a leaked copy of the script for "The Fifth Estate," a DreamWorks film about the maverick computer expert and his famed secret-busting site. In a speech before the Oxford Union debating society earlier this week, Assange said his unauthorized sneak peek has left him convinced the film is a hit piece.

"It is a mass propaganda attack against WikiLeaks, the organization (and) the character of my staff," he said, adding that the movie ? the opening scenes of which Assange described as taking place in Tehran and Cairo ? also hyped Western fears over the Islamic Republic's disputed atomic energy program.

"It is not just an attack against us, it is an attack against Iran. It fans the flames of an attack against Iran," he said.

A DreamWorks spokeswoman declined to comment on Assange's claims.

In a telephone interview late Friday, Assange said that the film's plot revolves around a fictional mole in Iran's nuclear program who discovers that the country has nearly finished building an atom bomb and will soon be in a position to load it onto ballistic missiles. The film has the informant fleeing to Iraq when WikiLeaks publishes his name among its massive trove of classified material.

Assange says the whole story is "a lie built on a lie," claiming that the U.S. intelligence community generally believes that Iran stopped comprehensive secret work on developing nuclear arms in 2003, and that, in any case, the world had yet to see evidence of a case in which WikiLeaks had exposed a CIA informant.

"They tried to frame Iran as having an active nuclear weapons program. Then they try to frame WikiLeaks as the reason why that's not known to the public now," Assange said, comparing the movie to Kathryn Bigelow's "Zero Dark Thirty," another film whose artistic liberties with recent history have drawn allegations of political bias.

Assange declined to say where he got the script, although he hinted that he had been supplied with several copies of it over time. He also declined to say whether the script would be posted to the WikiLeaks website, saying only that "we are examining options closely."

"The Fifth Estate" stars Benedict Cumberbatch as Assange and Daniel Bruhl as Daniel Domscheit-Berg, an early Assange ally who eventually fell out with WikiLeaks.

The film is due for release in November, and in a statement earlier this week director Bill Condon was quoted as saying that those behind the movie want "to explore the complexities and challenges of transparency in the information age" and "enliven and enrich the conversations WikiLeaks has already provoked."

Assange made his comments to the Oxford Union on Wednesday via videolink from the Ecuadorean Embassy in London, where he has been holed up for more than six months in a bid to avoid extradition to Sweden as part of a long-running sex crimes case.

P53 mutation hinders cancer treatment response

Jan. 25, 2013 ? Scientists from the National Cancer Centre Singapore (NCCS) have discovered the workings of the gene that has been hindering treatment response in cancer patients. This discovery was made after 5 years of studying the mutant form of the p53 gene, the major tumor suppressor in humans, which is generally found mutated in over 50% of all type of human cancers.

The dominant-negative (DN) effect of the mutant p53 gene in cancers was found to affect the outcome of cancer treatment modalities. DN effect is a phenomenon whereby one copy of mutant p53 that exists in cancer cells inhibits the tumor suppressor activity of the other wild-type p53 copy when they co-exist. The result is that a patient may either have poor response or earlier relapse of tumours after their treatment.

The research findings is significant in that it offers hope to improve cancer treatment outcomes by selectively inhibiting mutant p53's DN effect through several methods by generating selective and specific inhibitory molecules specific for some of the common hot-spot p53 point mutations. There are currently no drugs or compounds that can alleviate DN effects of mutant p53.

In order to understand the specific roles of mutant p53 DN properties in regulating acute treatment response and long-term tumourgenesis, a team of five researchers led by NCCS Prof Kanaga Sabapathy, the Principal Investigator in the Laboratory of Carcinogenesis and Head of the Division of Cellular & Molecular Research from NCCS, carried out experiments by generating genetically engineered knock-in mouse strains expressing varying levels of mutant p53. The results showed that DN effect is observed after acute p53 activation by a variety of chemotherapeutic drugs and irradiation, thereby affecting anti-cancer treatment. This breakthrough came after five years of intensive research.

It was found that mutant p53 have DN effects in a cell-type and dose-dependent manner, especially during acute p53 activation where p53 levels are elevated. Based on the above observations, efforts to generate specific inhibitors for the common hot spot p53 point mutations are underway. The inhibition of mutant p53 expression in cells carrying a wild-type and mutant p53 alleles can improve response to chemotherapeutic drugs.

In a further study, the researchers also questioned the possibility of the mutant p53 acquiring new functions (or Gain of Function) to drive carcinogenesis, transforming normal cells to cancerous cells. Their investigation comparing cells from genetically engineered mouse strains expressing 2 different types of p53 mutations: the R172H mutation versus the R246S mutation, which showed that Gain of Function (GOF) was found only in the former. This showed that GOF of mutated p53 is specifically dependent on mutation-type but not across all kinds of genetic mutations, highlighting diversity in properties of the different types of p53 mutations, thereby indicating that mutations found in human cancers can behave differently, and thus, need to be carefully assessed prior to treatment.

Thus, the existence of mutant p53 certainly has a negative impact on cancer treatment, whether it is through DN effect or GOF. Prof Sabapathy said that the team is now embarking on more research to determine the possibility of targeting mutant p53 without affecting wild-type p53 in human cells, paving way to clinical trials in the future to test the efficacy on cancer therapeutic response.

Crocodile crossing: Thousands on loose in S.Africa

JOHANNESBURG (AP) ? Afraid of crocodiles? Then you may want to stay away from the South Africa-Botswana border.

About 7,000 crocodiles escaped a crocodile farm when the gates on a dam were opened this week to alleviate pressure created by rising flood waters. About 2,000 have been recaptured, the Beeld newspaper reported Friday.

Video from the scene shows people hunting down the small-ish crocs at night, tying them up and taking them back to the Rakwena Crocodile Farm, in northern South Africa. The farm, which didn't respond to an email or calls seeking comment, used to hold 15,000 crocodiles.

The farm's website shows goods like crocodile-skin purses and hats for sale.

Northern South Africa and neighboring Mozambique have seen massive floods over the last week.

Apple's Savior: A New Cheaper iPhone? | Daily ... - Yahoo! Finance

Apple (APPL) shares were continuing to sink Thursday morning after the tech giant missed Wall Street's estimates for the fiscal first quarter. The stock has fallen roughly 10% on the news, which disappointed investors by falling short of their expectations.

But if you've looked at the numbers, you might wonder what the problem is, because Apple had a record quarter in more than one way. Here are the results, according to Apple:

  • The company posted record quarterly revenue of $54.5 billion and record quarterly net profit of $13.1 billion, or $13.81 per diluted share. These results compare with revenue of $46.3 billion and net profit of $13.1 billion, or $13.87 per diluted share, in the year-ago quarter.
  • It sold a record 47.8 million iPhones in the quarter, compared to 37 million in the year-ago quarter.
  • Apple also sold a record 22.9 million iPads during the quarter, up from 15.4 million last year.

Apple did, however, offer cautious guidance about the upcoming quarter and announced it will change the way it will provide earnings forecasts. The company will no longer provide a single number benchmark, which it has historically clobbered, but will instead offer a range for guidance.

"Beginning this fiscal year, we are reorganizing the presentation of our results to provide greater transparency," Apple Chief Financial Officer Peter Oppenheimer said on the earnings call. ?In recent years, our guidance reflected a conservative point estimate of results every quarter that we had reasonable confidence in achieving. Going forward, we plan to provide a range of guidance that reflects our belief of what we are likely to achieve.?

Apple predicts its fiscal second quarter will rake in between $41 billion and $43 billion in revenue, a stark decline from the latest quarter.

In the wake of the headlines, no less than seven analysts have cut their ratings for Apple.

Walter Piecyk, analyst at BTIG, joins The Daily Ticker in the accompany video to make sense of the numbers. He's had a neutral rating on Apple since last April when cell phone carriers tightened the rules around their upgrade policy. "Frankly, even in this quarter, had Verizon (VZ) and AT&T (T) and Sprint (S) not tightened up those upgrade policies, Apple probably could have sold 50 million iPhones," Piecyk says.

The other issue Apple faces is trying to penetrate global markets where people cannot afford a $600-plus phone.

"In order for Apple to stimulate growth, I think they need a cheaper phone," says Piecyk. Earlier this month, we reported that Apple may be contemplating a low-cost model of the iPhone to release later this year.

I know, I know.? It?s not October or November, yet I?m blogging about a pumpkin based recipe.? But you know what?? It IS January in New England, and it?s been about 10 degrees all week, so I think sharing two soup/stew recipes in one week, even if one of them is pumpkin based, is okay.? Don?t you?? We need to keep warm!? If you missed my other soup recipe this week, check it out here.

This year I want to make more crock pot recipes.? I think crock pots are so underrated, and sometimes I forget to think about what I can throw into the slow cooker when meal planning.? There are just so many benefits to cooking in the crock pot:

  • Better flavor due to longer cooking times
  • Less likely to burn your food due to lower cooking temperature
  • Food can get more moist and tender (he he he)
  • Frees up the stove top and oven for other dishes, this is convenient for larger gatherings
  • Convenience and ease!? Usually can be left unattended for long periods of time, freeing you to do other things while prepping dinner ? go to work, workout, relax, etc.
  • Minimal dishes to clean
  • Really hard to mess it up!

Ingredients

  • 1 can pumpkin pur?e
  • 1 can vegetable broth
  • 1 can?s worth of almond milk
  • 1 large green bell pepper, chopped
  • 1 small cooking onion, diced
  • 2 apples, peeled and chopped
  • 1 can of chick peas, drained and rinsed
  • 1 can of diced tomatoes, drained and rinsed
  • 1 can of pinto beans, drained and rinsed
  • 1/4 to 1/2 teaspoon ground cloves
  • Salt and pepper to taste
  • Basil to garnish

Directions

  1. Pour the pumpkin pur?e, vegetable broth, and almond milk into the pot of a slow cooker.? Stir until well incorporated.
  2. Toss in everything else, mix, and season.
  3. Set on high and cook between 3-4 hours, stirring every so often.

W.Va. average gas prices fall 2 cents per gallon

CHARLESTON, W.Va. (AP) -- Motorists are paying a little less for gas in West Virginia than they did a week ago.

AAA East Central says the average price for a gallon of regular gasoline is about $3.42, down 2 cents from a week ago.

The national average remained rose by a penny to $3.31.

The highest average price is in Martinsburg, where a gallon of regular costs about $3.60. Motorists in Parkersburg are paying the lowest price at $3.22. (backslash)

Paradise found for Latin America's largest land mammal

Wildlife Conservation Society scientists have documented a thriving population of lowland tapirs ? the strange forest and grassland-dwelling herbivore with the trunk-like snout ? living in a network of remote national parks spanning the Peru-Bolivia border.

Using a combination of camera traps, along with interviews with park guards and subsistence hunters, WCS estimates at least 14,500 lowland tapirs in the region. The population bridges five connected national parks in northwest Bolivia and southeastern Peru.

The WCS findings were described in the December issue of the journal Integrative Zoology. Authors include Robert Wallace, Guido Ayala, and Maria Viscara of WCS's Greater Madidi-Tambopata Landscape Program.

The study synthesizes 12 years of research on lowland tapirs in the region. Together with WCS studies on jaguars, the results underscore the importance of this protected area complex for the conservation of Latin America's most charismatic terrestrial wildlife species.

"The Madidi-Tambopata landscape is estimated to hold a population of at least 14,500 lowland tapirs making it one of the most important strongholds for lowland tapir conservation in the continent," said the study's lead author Robert Wallace. "These results underline the fundamental importance of protected areas for the conservation of larger species of wildlife threatened by hunting and habitat loss."

The lowland tapir is the largest terrestrial mammal in South America, weighing up to 300 kg (661 pounds). Its unusual prehensile proboscis or snout is used to reach leaves and fruit. Tapirs are found throughout tropical forests and grasslands in South America. However, they are threatened by habitat loss and especially unsustainable hunting due to their large size, low reproductive rate (1 birth every 2-3 years), and ease of detection at mineral licks in the rainforest. Lowland tapirs are considered Vulnerable by the IUCN.

WCS collected and systematized 1,255 lowland tapir distribution records in the region. These records came from research observations and camera trap photographs as well as interviews with park guards of Madidi, Pil?n Lajas and Apolobamba National Parks in Bolivia, and Bahuaja Sonene and Tambopata National Parks in neighboring Peru, and subsistence hunters from 19 Takana and Tsimane' communities.

Camera trap data revealed that lowland tapir abundance was higher at sites under protection than sites outside protected areas. At one site sampled over time, the Tuichi River, camera trapping has revealed that lowland tapir populations have been recovering following the creation of Madidi National Park in 1995. Prior to the creation of the park, loggers had hunted heavily in this area.

Madidi National Park contains 11 percent of the world's birds, more than 200 species of mammals, 300 types of fish, and 12,000 plant varieties. The 19,000 square-kilometer (7,335 square mile) park is known for its array of altitudinal gradients and habitats from lowland tropical forests of the Amazon to snow-capped peaks of the High Andes.

Working with government partners in Bolivia and Peru, the Greater Madidi-Tambopata Landscape Conservation Program aims to develop local capacity to conserve the landscape and mitigate a variety of threats to biodiversity and wildlife including lowland tapirs, including road construction, logging, unsustainable natural resource use, and agricultural expansion.

Julie Kunen, WCS Director of Latin America and Caribbean Programs said: "WCS commends our government and indigenous partners for their commitment to the Madidi-Tambopata Landscape. Their dedication is clearly paying off with well-managed protected areas and more wildlife."
